Mental capacity assessments

An unfortunate consequence of neurological illness or injury is that an individual’s ability to make informed decisions may be compromised as a result of cognitive and emotional disturbance.

The Mental Capacity Act (2005) provides a legal framework within which to assess an individual’s decision-making processes, and provide protection for vulnerable adults should their mental capacity be diminished. Gray Matter Neuropsychology Services provides such assessments that can then be used as evidence as part of an application to the Court of Protection. We accept referrals from solicitors, case managers, and other healthcare professionals.

We examine mental capacity around a wide range of decision-making areas, with the majority of our referrals seeking clarification regarding an individual’s:
  • Capacity to manage property and affairs;
  • Testamentary capacity;
  • Capacity to litigate and manage legal proceedings;
  • Capacity to consent to medical procedures;
  • Capacity to make decisions regarding residence and care needs;
  • Capacity to consent to sexual relations;
  • Capacity to consent to marriage.

We accept referrals from self-funders as well as solicitors, case managers, and other health and social care professionals. We provide domiciliary visits as well as the option of patients being seen at our office in north Oxford. We also offer the option of remote appointments as well as in-person sessions.
